Often, non-smokers complain that smokers get more breaks. It might not be fair, but most of the time there's no law against it. It would only be a problem if groups of workers were being treated differently in a way that violates anti-discrimination laws, which would usually be hard to show.
Non-smokers can try to get their boss to let them take a small break, just to breathe fresh air or make a quick phone call, that doesn't last longer than the smoke breaks.
